Welcome to Blue Harvest Asian Market. “We,” “us,” and “our” refer to Blue Harvest Asian Market, the operator of this store. Our website, product listings, content, features, and related services are collectively referred to as the “Services.” Shopify provides the commerce platform that supports our online store. These Terms and Conditions (“Terms”), together with the policies referenced here, describe the rules for using the Services and placing orders. Acceptance and Eligibility

By accessing or using the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services. You represent that you are legally able to enter into an agreement and that the information you provide is accurate. You are responsible for keeping your account credentials secure and for using the Services lawfully.

Products and Information

Our online selection includes household products such as cleaning brushes, laundry bags, personal care accessories, and storage items. We aim to describe products, materials, sizes, quantities, and colors accurately. Measurements may be approximate, and colors can appear differently on screens. Product availability and descriptions may change. If you need clarification about an item, please contact us before ordering.

Order Acceptance

Placing an order is an offer to purchase. An order confirmation acknowledges receipt of your order and does not necessarily mean it has been accepted. We may decline or cancel an order for reasons such as product unavailability, a pricing or listing error, suspected fraud, or a delivery restriction. If we cancel an order after payment, we will refund the amount paid for the canceled items to the original payment method.

Pricing and Payment

Prices are in U.S. dollars unless otherwise stated. Applicable taxes and the final total are shown at checkout before you submit an order. We may correct pricing or listing errors and will contact you before proceeding if a correction materially changes the amount due. Payment is handled through the options available at checkout; an order moves forward after payment is confirmed. See our Payment Policy for details.

Shipping and Delivery

We ship within the United States and offer free shipping. Orders are generally processed within 1–3 business days, and estimated transit time is 3–5 business days after dispatch. Our order cutoff is 2:00 PM Pacific Time. We use UPS for delivery. These timeframes are estimates and may be affected by carrier operations, weather, holidays, or other circumstances. Returns, Exchanges, and Refunds

Eligible return or exchange requests must be made within 30 days after delivery and are subject to the conditions and procedures in our Refunds & Returns Policy. That policy also explains return shipping responsibilities, damaged or incorrect items, and refund processing. Please contact us before sending an item back.

Order Cancellation

If you wish to cancel before your order has shipped, please contact us as soon as possible. We will cancel the unshipped order and issue a full refund to your original payment method without an additional handling fee. Once an order has shipped, cancellation is no longer available; please contact us to follow the returns and refund process.

Intellectual Property

Store content, including text, graphics, photographs, logos, and website design, belongs to or is licensed to Blue Harvest Asian Market or the respective rights holders and is protected by applicable intellectual property laws. You may use the Services for personal shopping. You may not reproduce, distribute, modify, or commercially exploit content without permission, except as permitted by law.

Disclaimer and Limitation of Liability

To the fullest extent permitted by law, the Services and products are provided without warranties beyond those expressly stated or required by applicable law. We do not exclude warranties or consumer rights that cannot lawfully be excluded.

TO THE FULLEST EXTENT PERMITTED BY LAW, BLUE HARVEST ASIAN MARKET AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND SHOPIFY AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, REVENUE, SAVINGS, OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS. TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM RELATED TO AN ORDER WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THAT CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY OR RIGHTS THAT CANNOT LAWFULLY BE LIMITED.

Termination

We may suspend or terminate access to the Services when reasonably necessary to address a violation of these Terms, suspected fraud, misuse, security issues, or other legitimate business or legal concerns, subject to applicable law. You remain responsible for amounts due through termination. Provisions that by their nature should continue, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law, survive termination.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Blue Harvest Asian Market, Shopify, and their respective affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, and reasonable legal costs arising from your breach of these Terms, unlawful use of the Services, or violation of another person’s rights. This obligation does not apply to the extent a claim arises from an indemnified party’s own negligence or misconduct, or where the law does not permit it.

We will notify you of a claim for which we seek indemnification. We may control its defense and settlement at your expense, subject to applicable law; we will not agree to a settlement imposing non-monetary obligations on you without your consent, which will not be unreasonably withheld. You agree to cooperate reasonably with the defense.

Governing Law

These Terms are governed by the laws of the State of Texas and applicable United States federal law, without limiting any mandatory consumer protections that apply where you live. Any dispute will be brought in a court with proper jurisdiction, subject to applicable rights concerning venue.

Changes to These Terms

We may revise these Terms from time to time. Updates will be posted on this page and take effect when posted unless a later date or applicable law requires otherwise. Continued use of the Services after the updated Terms take effect constitutes acceptance of the changes.
